1. Agreement to Terms

By accessing and using Gifted Tales (www.gifted-tales.com), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Service Description

Gifted Tales is a service operated by Paramount Enterprise Solutions (Registration: 2024/611570/07), trading as Gifted Tales. We provide personalized AI-generated storybooks featuring your child's photo and custom story. Books are delivered as downloadable PDF files.

3. User Accounts & Eligibility

To use Gifted Tales, you must:

• Be at least 18 years old or have parental consent
• Provide accurate personal information during registration
• Be responsible for maintaining account security
• Comply with South African law

4. Photo & Child Consent

You confirm that you have the right to provide your child's photo to us. By uploading a photo, you grant Gifted Tales a license to:

• Use the photo to generate your personalized storybook
• Generate character models for story illustrations
• Store the photo securely for your account

Privacy: We never share your child's photo or data with third parties without your explicit consent. See our Privacy Policy for full details.

5. Bookshelf Showcase (Optional)

If you opt-in to share your book in our Bookshelf Showcase, you grant us permission to display the book preview and cover to other users. Your child's identity and personal information remain protected. You can withdraw this permission at any time.

6. Payment & Purchases

• Currency: All prices are in South African Rands (ZAR)
• Payment Processing: Payments are processed via Yoco, a PCI-compliant payment gateway
• Pricing: Prices are subject to change with notice
• Refunds: Digital products are non-refundable once downloaded. We may refund if the book fails to generate through no fault of the customer
• Promoter Codes: Referral codes offer 10% discount on first purchase. Store credit is earned when referrals complete purchase

7. Intellectual Property

• Your Story: You own the copyright to your personalized book once purchased and downloaded
• Our Property: Gifted Tales branding, illustrations, templates, and technology are our property
• Personal Use Only: You may print one copy for personal use. Commercial reproduction is prohibited without permission

8. Acceptable Use

You agree NOT to:

• Upload inappropriate or harmful images
• Use the service for illegal purposes
• Harass, abuse, or threaten other users
• Attempt to reverse-engineer or hack the platform
• Scrape or bulk download content without permission
• Resell or distribute books as your own work

9. AI-Generated Content

Our service uses artificial intelligence to generate stories and illustrations. While we employ multi-AI verification to ensure quality:

• Content may occasionally contain errors or inconsistencies
• AI-generated text and images are not guaranteed to match expectations perfectly
• You can regenerate stories/images if unsatisfied
• We reserve the right to decline requests that violate content guidelines

10. Limitation of Liability

Gifted Tales is provided "as is" without warranties. To the maximum extent permitted by South African law, we are not liable for:

• Loss of data or files
• Service interruptions or technical errors
• Indirect or consequential damages
• Issues arising from misuse or unauthorized access

11. Service Availability

We strive for 99% uptime but do not guarantee uninterrupted service. We may take down the service for maintenance with reasonable notice.

12. Termination

We reserve the right to terminate or suspend your account if you violate these terms or engage in harmful behavior. You may close your account anytime by contacting us.

13. Changes to Terms

We may update these terms at any time. Continued use of the service constitutes acceptance of updated terms. We will notify you of material changes via email.

14. Governing Law

These terms are governed by the laws of South Africa. Any disputes shall be resolved in South African courts.
